1. About these terms

These terms govern the supply of bid writing, bid review, bid management, bid library and retainer services by Gautam Group. They apply alongside the written quotation or statement of work agreed for each engagement.

Where a signed statement of work conflicts with these terms, the statement of work takes precedence for that engagement.

2. Quotations and fees

Fees are quoted in writing before work begins and are fixed for the scope described in that quotation. Changes to scope, including additional questions, lots or extensions to word counts, may require a revised fee agreed in writing.

Where a success-based element is agreed, the trigger, amount and payment timing will be set out expressly in the quotation.

3. Your responsibilities

You agree to provide the tender documentation, access to relevant personnel and any supporting evidence reasonably required, within the timescales agreed. Delays in providing these may affect deadlines and, in some cases, the fee.

You remain responsible for the accuracy of factual information you supply, including financial figures, accreditations, insurances and case study details.

4. Submission and outcomes

Unless expressly agreed as part of a bid management engagement, responsibility for final approval and submission of a tender rests with you.

We do not guarantee any particular outcome. Procurement decisions are made by the contracting authority against criteria and competition outside our control.

5. Confidentiality

We treat your tender documentation, pricing and commercial information as confidential and will not disclose it to third parties without your consent, except where required by law.

We will not name you as a client in marketing material without your prior agreement.

6. Intellectual property

On payment in full, ownership of the bespoke written content we produce for your submission passes to you.

Our underlying templates, frameworks, tools and general know-how remain our property and may be reused across engagements.

7. Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

Subject to that, our total liability arising out of any engagement is limited to the fees paid for that engagement.

8. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
